These Terms and Conditions of Use (“Terms”) govern your access to and use of the website located at https://snapn.win, its subdomains, and the related websites, campaign pages, photo experiences, information, and services operated by Snap & Win (collectively, the “Website” and “Services”).

The Website is operated by Snap & Win (“Company,” “we,” “us,” or “our”).

By accessing or using our Website or Services, you agree to these Terms. If you do not agree, please do not use our Website or Services.

Certain photo experiences, promotional campaigns, and giveaways may have additional terms or Official Rules. Those requirements apply in addition to these Terms. If the specific rules of a promotion conflict with these general Terms concerning the operation of that promotion, the promotion’s specific rules will govern, subject to applicable law.

1. Privacy Policy

Your use of our Website and Services is also subject to our Privacy Policy, which describes how we collect, use, store, and share personal information.

By using our Services, you acknowledge that your personal information will be handled as described in that policy and any additional notices provided for the particular campaign.

Where separate consent is required for a particular activity, it will be requested separately.

2. Age Requirements

Our Website’s interactive photo experiences and promotional campaigns are intended for individuals who are at least 18 years of age.

You must be at least 18 years old to independently register for a promotional campaign, provide participant information, or enter into these Terms.

By registering for a Snap & Win campaign, you represent that you are at least 18 years old.

An adult who is a parent or legal guardian may participate in a photo experience that includes their child, subject to the applicable campaign rules and photo-use permissions.

Individuals under 18 may not independently register for our promotional campaigns or submit their personal information through our Services.

3. Lawful Use of the Website

You agree to use our Website and Services only for lawful purposes and in accordance with these Terms.

You agree not to:

• Submit false, misleading, fraudulent, or impersonated registration information.
• Attempt to interfere with the operation, security, or availability of our Website or Services.
• Use automated systems, bots, or other unauthorized methods to manipulate promotional entries.
• Submit photographs or other material that violates another person’s privacy, intellectual property, or other legal rights.
• Upload material that is unlawful, threatening, harassing, defamatory, obscene, or otherwise prohibited by applicable law.
• Attempt to gain unauthorized access to campaign information, participant records, photo galleries, or other restricted resources.
• Copy, reproduce, distribute, or commercially exploit our Website content without authorization.

We reserve the right to restrict access to our Services or disqualify participation when we reasonably determine that a user has violated these Terms or the applicable campaign rules.

4. Snap & Win Photo Experiences

Snap & Win provides interactive photo experiences through Fiesta, a third-party photo-experience platform.

A standard experience may allow participants to create a photograph, provide an email address for photo delivery, confirm participation information, and enter a promotional giveaway.

The specific features and participation requirements may vary by campaign.

By participating, you authorize Snap & Win and its necessary service providers to process your photograph and the information you submit for the purpose of providing the requested photo experience, delivering your photograph, administering the promotion, and performing the activities disclosed in the applicable campaign notices.

Your photograph may be processed and stored through Fiesta and delivered to the email address you provide.

We cannot guarantee that every photograph will be successfully created, processed, or delivered. Technical interruptions, device compatibility, incorrect email addresses, internet connectivity, and third-party service availability may affect the experience.

If you experience a technical problem, you may contact us using the information at the end of these Terms.

5. Photographs and Participant Submissions

You retain any ownership and intellectual property rights you lawfully hold in photographs, artwork, written material, or other content you submit through our Services (“Participant Submissions”).

You grant Snap & Win and its necessary service providers a nonexclusive, royalty-free license to process, reproduce, store, transmit, and deliver your Participant Submissions to the extent reasonably necessary to provide the requested experience, administer the applicable campaign, and fulfill the purposes disclosed to you.

This permission does not transfer ownership of your photographs or other original material to Snap & Win.

Sponsoring Business Gallery Access

The business or organization sponsoring your campaign (“Sponsoring Business”) may receive access to an online gallery containing photographs created during the campaign.

The Sponsoring Business may be able to view and download photographs from that gallery.

Gallery access is intended for Snap & Win and the Sponsoring Business associated with the campaign. It is normally discontinued 30 days after the campaign ends, unless the Sponsoring Business purchases extended access.

Disabling the gallery does not delete photographs that were previously downloaded by the Sponsoring Business or necessarily delete photographs stored by Fiesta.

Promotional Use of Photographs

Participating in a Snap & Win experience does not automatically authorize Snap & Win or the Sponsoring Business to publish your identifiable photograph in advertising, on social media, or in other promotional materials.

Separate permission will be requested for promotional photograph use, as appropriate to the intended use.

Permission to access or download campaign photographs is separate from permission to publish them for advertising or promotional purposes.

Your Responsibilities

You represent that you have the necessary rights and permissions to submit the photographs and other materials you provide.

If your photograph includes other individuals, you are responsible for obtaining any permissions required for your participation and the authorized use of the photograph.

When a photograph includes a minor, the participating parent or legal guardian must have the legal authority to provide any applicable permission on the minor’s behalf.

You agree not to submit material that infringes another person’s copyright, trademark, privacy, publicity, or other legal rights.

6. Promotional Campaigns and Giveaways

Snap & Win operates promotional campaigns and giveaways for Sponsoring Businesses.

Each promotion may have its own Official Rules establishing its specific terms and participation requirements.

These rules may address:

• The identity of the Sponsoring Business and promotion sponsor.
• Eligibility and geographic restrictions.
• The promotion’s beginning and ending dates.
• Entry methods and entry limits.
• The prize or prizes offered.
• Winner-selection procedures.
• Winner notification and prize-claim requirements.
• Any applicable restrictions or additional conditions.

You are responsible for reviewing and complying with the Official Rules for the promotion you enter.

Unless the applicable promotion lawfully provides otherwise, no purchase is necessary to enter or win a chance-based promotional giveaway, and a purchase will not increase your chances of winning.

The Sponsoring Business is responsible for providing and fulfilling the prizes associated with its promotion unless the applicable Official Rules expressly identify a different responsible party.

Snap & Win does not guarantee that any participant will win a prize.

Winner selection, notification, and prize fulfillment are governed by the applicable Official Rules.

Participation in a photo experience does not guarantee that a giveaway entry has been successfully completed. You must complete the required entry steps and satisfy the applicable eligibility requirements.

Where applicable law requires an alternative entry method, registration, disclosures, or other safeguards, the promotion must provide them.

7. Email Communications and Marketing Consent

During a Snap & Win photo experience, you may be asked to provide an email address so Fiesta can deliver your photograph.

Providing an email address for photo delivery does not, by itself, subscribe you to promotional email communications through Connect & Convert.

After the photo experience, you may be directed to the Connect stage to confirm your email address, provide additional campaign information, and choose whether to receive promotional communications from the Sponsoring Business.

Marketing permission is requested separately from the information needed to provide your photograph and administer the giveaway.

You may decline optional promotional-email consent without automatically forfeiting your eligibility for the photo experience or giveaway, subject to the applicable campaign rules.

Participants who provide marketing permission may receive promotional emails from the Sponsoring Business, including communications delivered on its behalf through Connect & Convert.

A standard Snap & Win campaign may include three to five follow-up emails. These communications may include participation updates, giveaway information, winner announcements, and promotional offers.

Promotional messages will be sent only where authorized by the applicable marketing permission or another valid legal basis.

You may unsubscribe from promotional emails using the unsubscribe link provided in the relevant message.

8. Participant Information and Sponsoring Businesses

When you participate in a Snap & Win campaign, your information may be shared with the Sponsoring Business associated with that campaign.

The Sponsoring Business may receive participant contact information, campaign responses, photographs, and other information collected for the promotion.

The Sponsoring Business may also receive a copy of the participant list following the campaign.

The Sponsoring Business is responsible for its independent use of participant information, including compliance with applicable privacy laws, honoring marketing preferences, and processing unsubscribe requests.

Declining promotional-email consent does not necessarily prevent your information from being provided to the Sponsoring Business for the disclosed purposes of administering the promotion.

Snap & Win may continue managing participant information and communications on behalf of a Sponsoring Business that purchases ongoing Connect & Convert services.

Please review our Privacy Policy for additional information about how participant information is collected, shared, retained, and deleted.

9. Our Intellectual Property

The Snap & Win Website contains content and intellectual property owned by Snap & Win or used with permission from third parties.

This may include our business name, logos, branding, website designs, graphics, written content, promotional materials, templates, and other creative or technical assets.

These Terms grant you a limited, nonexclusive, nontransferable, revocable permission to access and use our Website and Services for their intended purposes.

Except where expressly authorized, you may not copy, reproduce, sell, redistribute, modify, publish, or otherwise commercially exploit our protected content without our prior written permission.

You do not acquire ownership of Snap & Win’s intellectual property by accessing or using our Website.

Photographs and other Participant Submissions remain subject to the ownership and usage provisions described in Section 5.

Third-party trademarks, logos, photographs, and other intellectual property remain the property of their respective owners.

10. Free Resources and Downloadable Content

We may occasionally provide free resources, guides, templates, or other downloadable materials through our Website.

Unless otherwise stated, these materials are provided for your personal or internal business use only.

You may not resell, redistribute, or commercially exploit these materials without our prior written permission.

Any additional usage permissions or restrictions will be identified with the relevant resource.

11. Third-Party Services and External Websites

Our Website and Services may use or link to third-party platforms, including photo-experience software, email-delivery services, campaign websites, and websites operated by Sponsoring Businesses.

These third parties may have their own terms, privacy policies, and service practices.

Snap & Win does not control the independent operation or content of external websites that we do not own or operate.

A link to an external website does not necessarily indicate that Snap & Win endorses its products, services, or content.

Your use of external websites and third-party services may be subject to additional terms established by their respective operators.

12. No Guarantee of Availability

We make reasonable efforts to maintain the availability and functionality of our Website and Services.

However, access may occasionally be interrupted or delayed because of maintenance, internet connectivity, third-party service problems, software errors, equipment failures, or other circumstances.

We do not guarantee uninterrupted or error-free access to the Website, photo experiences, galleries, email delivery, or related services.

We may modify, suspend, or discontinue portions of our Website or Services when reasonably necessary for maintenance, security, legal compliance, or operational requirements.

These Terms do not eliminate any rights or remedies that cannot lawfully be excluded.

13. Disclaimers and No Warranties

The Website, its content, and related Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, Snap & Win disclaims warranties concerning the uninterrupted availability, accuracy, completeness, reliability, or fitness for a particular purpose of the Website and related Services.

We do not guarantee that participation in a promotional campaign will result in winning a prize or obtaining any particular benefit.

Nothing in these Terms excludes warranties, consumer protections, or other rights that cannot lawfully be excluded.

We may restrict or terminate access when reasonably necessary to protect our Website, participants, Sponsoring Businesses, or service providers.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Snap & Win from third-party claims, liabilities, losses, and reasonable expenses arising from your unlawful use of the Services, your infringement of another person’s rights, or your material violation of these Terms.

This provision does not require you to indemnify Snap & Win for its own unlawful conduct or for liability that cannot lawfully be transferred to you.

17. Changes to These Terms

We may update these Terms to reflect changes in our Services, business operations, technology, or applicable legal requirements.

When we update these Terms, we will revise the “Last updated” date at the beginning of this page.

Changes will become effective when published unless otherwise stated or required by applicable law.

Your continued use of our Website or Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

Where additional notice or affirmative acceptance is required, we will provide it as appropriate.

These Terms, together with our Privacy Policy, applicable campaign-specific rules, and any other terms expressly incorporated by reference, govern your use of our Website and Services.

Separate written agreements between Snap & Win and Sponsoring Businesses may establish additional terms governing the purchase and operation of campaign services.

Failure by Snap & Win to enforce a provision of these Terms does not constitute a waiver of the right to enforce that provision in the future.

All rights not expressly granted are reserved.
