Snap & Win provides interactive photo experiences, promotional giveaways, lead collection, and campaign-related communications for businesses and organizations (referred to in this policy as “Sponsoring Businesses”).

When you participate in a Snap & Win campaign, we collect and process information to operate the experience and provide services to the Sponsoring Business associated with that campaign.

Individual campaigns may include additional participation rules, information requests, and privacy disclosures. Please review the information provided for your particular campaign before participating.

1. Personal Information We Collect

We collect personal information directly from you, automatically through our Website and Services, and through third-party providers that assist us in operating our campaigns.

Information You Provide

Depending on the particular campaign or service, we may collect:

  • First and last name.
  • Email address.
  • Telephone number.
  • Mailing address.
  • Business or professional contact information.
  • Photographs created or submitted through our photo experiences.
  • Giveaway registration information and campaign responses.
  • Communication preferences and marketing-consent records.
  • Information submitted through contact forms, registration forms, or other campaign-specific questions.

An email address is normally the minimum contact information requested during a Snap & Win photo experience.

Additional information may be requested depending on the purpose of the campaign and the needs of the Sponsoring Business.

For example, a trade-show campaign may request a participant’s name, mailing address, telephone number, and business information.

The information requested for a particular campaign will be presented during registration or participation.

Information Collected Automatically

When you visit our Website or participate in a campaign, we and our service providers may automatically collect certain information about your device and your interactions with our Services.

This information may include:

  • IP address.
  • Browser type and device type.
  • Operating system.
  • Approximate geographic location.
  • Referring website or traffic source.
  • Pages visited and links clicked.
  • Dates and times of website interactions.

Photographs and Photo-Delivery Information

Snap & Win uses Fiesta, a third-party photo-experience platform, to provide interactive photo experiences.

When you participate, your photograph is processed through Fiesta.

During the photo experience, Fiesta requests an email address so that your photograph can be delivered to you.

The email address you provide for photo delivery is processed through Fiesta and may be retained in its campaign records, including records that can be exported by Snap & Win.

Providing your email address to Fiesta for photo delivery does not, by itself, subscribe you to promotional email communications through Connect & Convert.

Following the photo experience, you may be directed to the Connect stage, where you can confirm your email address, provide applicable campaign information, and choose whether to receive promotional communications from the Sponsoring Business.

Information Received From Third Parties

We may receive personal information from Sponsoring Businesses, photo-experience providers, website forms, email-service providers, and other organizations that assist us in operating our Services.

We may combine this information with information collected directly from you when reasonably necessary to operate the relevant campaign or provide our Services.

2. How We Use Your Personal Information

We use personal information to operate our Website, provide requested services, administer promotional campaigns, and communicate with participants and Sponsoring Businesses.

Depending on your interaction with Snap & Win, we may use your information to:

  • Provide access to our photo experiences.
  • Create, process, store, and deliver photographs.
  • Register participants for promotional giveaways.
  • Administer drawings, verify eligibility, and communicate giveaway results.
  • Send participation confirmations and other necessary campaign-related communications.
  • Provide participant information to the Sponsoring Business associated with your campaign.
  • Send promotional communications on behalf of a Sponsoring Business when authorized.
  • Manage email subscriptions, communication preferences, and unsubscribe requests.
  • Respond to inquiries and provide customer support.
  • Measure campaign participation and performance.
  • Maintain and improve our Website and Services.
  • Detect and prevent fraud, unauthorized access, and misuse.
  • Comply with applicable laws and protect our legal rights.

We may also use aggregated or de-identified information for reporting and service improvement when that information does not reasonably identify an individual.

Marketing on Behalf of Sponsoring Businesses

Snap & Win operates promotional campaigns on behalf of other businesses and organizations.

Our campaigns may include an initial sequence of three to five emails delivered through our Connect & Convert email-marketing infrastructure.

These communications may include participation updates, giveaway information, winner announcements, promotional offers, and other campaign-related messages.

Promotional communications are sent in accordance with applicable law and the marketing permission obtained from participants.

A Sponsoring Business may purchase ongoing Connect & Convert services to continue communicating with participants who have provided the applicable marketing permission.

Snap & Win does not use participant information collected through a Sponsoring Business’s campaign to independently market Snap & Win’s own products or services to those participants.

3. How We Share Your Personal Information

We may share personal information with Sponsoring Businesses, third-party service providers, and other parties when necessary to operate our Services or comply with applicable law.

Sponsoring Businesses

When you participate in a Snap & Win campaign, your information may be shared with the Sponsoring Business associated with that campaign.

The Sponsoring Business may have access to participant information during the campaign and may receive a copy of the participant information following the campaign.

Information shared may include your name, email address, telephone number, mailing address, campaign responses, marketing-consent status, and other information collected during the experience.

The Sponsoring Business may use this information to administer its promotion, communicate with participants, and conduct subsequent marketing activities where permitted by applicable law and the permissions obtained.

Marketing consent is optional, and declining marketing consent does not prevent your information from being shared with the Sponsoring Business for the disclosed purposes of administering the campaign.

The Sponsoring Business is responsible for honoring applicable unsubscribe requests, marketing preferences, and privacy rights when independently using participant information.

After receiving participant information, the Sponsoring Business is responsible for its independent use, storage, and protection of that information.

If you have questions about how a Sponsoring Business uses information independently of Snap & Win, you may contact that business directly.

Photograph Galleries

Snap & Win may provide the Sponsoring Business associated with your campaign with a link to an online photo gallery hosted through Fiesta.

Gallery access is intended for Snap & Win and the Sponsoring Business associated with the campaign.

The Sponsoring Business may be able to view and download photographs available through the gallery.

Gallery access is normally discontinued 30 days after the campaign ends, unless the Sponsoring Business purchases an extension of gallery access.

Disabling access to the online gallery does not delete copies of photographs previously downloaded by the Sponsoring Business.

Photographs may also remain stored by Fiesta according to its service settings and retention arrangements.

Promotional Use of Photographs

Participation in a Snap & Win photo experience does not automatically grant Snap & Win or the Sponsoring Business unrestricted permission to use identifiable participant photographs in advertising, social media, or other promotional materials.

Separate permission will be requested when photographs are intended for such purposes.

Participants may decline optional promotional photo-use permission without automatically forfeiting their eligibility for the photo experience or giveaway, subject to the applicable campaign rules.

Permission to view or download photographs through a campaign gallery is separate from permission to publish photographs for promotional purposes.

Third-Party Service Providers

We use third-party providers to support our Website, photo experiences, email communications, and campaign operations.

Our service infrastructure includes:

Ethernet Servers: Website hosting and associated technical infrastructure.

WordPress: Website and campaign-page management.

Fluent Forms: Registration forms, participant information collection, and consent-related form submissions.

Fiesta: Photo creation, processing, storage, galleries, and photo delivery.

MailWizz: Subscriber management, consent records, and email automation.

Connect & Convert: Campaign-related and ongoing email-marketing services operated by us.

Amazon Simple Email Service (SES): Email delivery infrastructure.

Switchy: Branded links, QR-code destinations, and link tracking.

Google Analytics: Analytics for our main marketing website when enabled.

These providers may process or store information as necessary to perform their services.

The providers involved may vary depending on the configuration of the particular campaign.

Legal Requirements

We may disclose personal information when required to comply with applicable laws or regulations, respond to lawful requests from public authorities, enforce our agreements, protect our rights, or address security and fraud concerns.

4. How We Store and Protect Your Information

We use website hosting, photo-experience software, email-management systems, and other third-party services to process and store personal information.

These services may process or store information in the United States or other locations, depending on the infrastructure and arrangements of the relevant provider.

We use commercially reasonable security measures intended to protect personal information against unauthorized access, alteration, disclosure, loss, or destruction.

However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

Participant Information and Email-List Retention

Snap & Win retains participant information for the duration of the applicable promotional campaign and any ongoing Connect & Convert services purchased by the Sponsoring Business.

Following completion of the campaign and its included email communications, Snap & Win provides the Sponsoring Business with the participant information collected on its behalf.

If the Sponsoring Business does not continue with Connect & Convert, Snap & Win deletes the associated participant records from its active MailWizz subscriber-management system within 30 days after confirmed delivery of the information to the Sponsoring Business.

If the Sponsoring Business purchases ongoing Connect & Convert services, we retain the relevant participant information for the duration of that service relationship.

When the ongoing service ends, we provide the information to the Sponsoring Business and delete the associated participant records from our active subscriber-management system within 30 days after confirmed delivery.

Certain limited information may be retained for longer when reasonably necessary for legal compliance, security, consent documentation, unsubscribe suppression, dispute resolution, or other legitimate purposes permitted by applicable law.

Information stored in system backups may remain until those backups are deleted or overwritten according to the applicable backup procedures.

Deletion from MailWizz does not automatically delete information separately stored by Fiesta or information previously provided to the Sponsoring Business.

Photograph and Fiesta Record Retention

Photographs and photo-delivery information are processed and stored through Fiesta, our third-party photo-experience provider.

Snap & Win normally discontinues the Sponsoring Business’s access to the online gallery 30 days after campaign completion, unless an extension has been purchased.

This access period is separate from the period during which photographs and associated information may remain stored by Fiesta.

Photographs and photo-delivery records may remain within Fiesta according to its service settings, storage arrangements, and applicable retention procedures.

Sponsoring Businesses may retain copies of photographs or information they previously downloaded.

Their independent retention and use of those materials are subject to applicable law and their own privacy practices.

You may contact us to request information about the retention or deletion of photographs or personal information associated with your participation.

5. Children’s Privacy

Snap & Win’s online photo experiences and promotional campaigns are intended for individuals who are at least 18 years of age.

Individuals under 18 may not independently register for our promotional campaigns or submit their personal information through our Services.

Adult participants may be asked to confirm that they are at least 18 years old when accepting participation terms or completing registration.

A parent or legal guardian who is at least 18 years old may participate in a photo experience that includes their child, subject to applicable campaign rules and photo-use permissions.

We do not knowingly solicit personal information directly from individuals under 18.

If we become aware that a minor has independently provided personal information in violation of this policy, we will take appropriate steps to address or delete that information.

Parents or legal guardians may contact us at team@snapn.win with questions or concerns about photographs or personal information involving their children.

6. Email Communications and Marketing

Snap & Win provides photo delivery, campaign-related communications, and promotional email services on behalf of Sponsoring Businesses.

Photo Delivery Through Fiesta

During the photo experience, participants provide an email address through Fiesta so their photograph can be delivered.

Providing an email address for photo delivery does not, by itself, subscribe a participant to promotional email communications through Connect & Convert.

Photo-delivery information remains subject to Fiesta’s applicable processing and storage arrangements.

Email Confirmation and Consent at the Connect Stage

Following the photo experience, participants may proceed to the Connect stage.

At this stage, participants may confirm their email address, provide additional campaign information, and choose whether to receive promotional communications from the Sponsoring Business.

Marketing consent is requested separately from the information needed to provide the photo experience and administer the giveaway.

Participants may decline optional promotional-email consent without automatically forfeiting their eligibility for the photo experience or giveaway, subject to the applicable campaign rules.

Participants who provide marketing permission may be added to the Sponsoring Business’s marketing list and receive promotional communications through Connect & Convert.

Participants who decline marketing permission may still receive communications necessary to administer the promotion, including applicable giveaway and winner notifications.

Declining marketing consent does not authorize the Sponsoring Business to use the participant’s information for unrelated promotional email campaigns.

Campaign Follow-Up

A standard Snap & Win campaign may include three to five follow-up emails sent through Connect & Convert on behalf of the Sponsoring Business.

These communications may include campaign updates, giveaway information, winner announcements, special offers, and other campaign-related messages.

Promotional messages are sent only where authorized by the applicable marketing permission or another valid legal basis.

Following the campaign, the Sponsoring Business may continue marketing to participants where permitted by applicable law and the permissions obtained.

Unsubscribing

You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the relevant message or by contacting us.

We will process unsubscribe requests for communications managed through our systems and coordinate with the Sponsoring Business where appropriate.

Unsubscribing from promotional communications may not prevent you from receiving messages necessary to administer an active promotion, fulfill a request, or comply with applicable legal obligations.

When a Sponsoring Business independently manages its own email communications, you may need to use the unsubscribe mechanism provided in its messages or contact that business directly.

7. Cookies and Website Analytics

Snap & Win uses website technologies to support website functionality, understand website usage, and measure campaign activity.

Cookies are small data files that websites may place on your device. They may support website functionality, recognize preferences, and provide information about visitor activity.

Main Marketing Website

Our main marketing website may use Google Analytics to measure website visits, traffic sources, and visitor interactions.

Google Analytics may collect information through cookies and related technologies when enabled.

Where applicable law requires consent or additional choices for nonessential analytics cookies, we will provide the required disclosures and controls.

Client Campaign Pages

Our standard client campaign pages do not use Google Analytics or Meta Pixel for advertising or visitor tracking.

However, operational analytics may be provided by Fiesta, Switchy, WordPress, and our website-hosting infrastructure.

These systems may collect technical information or interaction data to operate the experience, manage QR-code destinations, maintain security, and measure campaign participation.

Some third-party services may use cookies or similar technologies as part of their operations.

Managing Cookies

You can configure your browser to reject or delete cookies.

Disabling cookies may affect certain website features or services.

Where required by applicable law, additional cookie notices or consent controls will be provided.

8. Behavioral Advertising

Snap & Win does not use participant information collected through Sponsoring Businesses’ campaigns to independently market Snap & Win’s products or services to those participants.

Our standard client campaign pages do not use Google Analytics or Meta Pixel for advertising or remarketing.

If our advertising or tracking practices change, we will update this policy and provide any additional disclosures or privacy choices required by applicable law.

9. Your Data Protection Rights

Depending on your location and applicable law, you may have rights concerning the personal information we collect or process.

These rights may include the ability to:

  • Request access to your personal information.
  • Request correction of inaccurate personal information.
  • Request deletion of your personal information, subject to applicable exceptions.

Snap & Win currently offers its campaigns in the United States.

Where the European Union General Data Protection Regulation, United Kingdom data-protection law, or another applicable law governs our processing, individuals may have additional rights, including access, rectification, erasure, restriction, objection, data portability, and the right to complain to a competent supervisory authority.

Snap & Win is not responsible for the independent privacy practices of websites that we do not operate or control.

We may update this Privacy Policy from time to time to reflect changes in our business operations, technology, information-processing practices, or applicable legal requirements.
